These Terms and Conditions (“Terms”) govern your access to and use of the website https://www.thriverawfoodfordogs.co.za/ (“Site”) and the purchase of any Thrive Food For Dogs (“TFFD”, “we”, “us”, “our”) products offered on the Site. By browsing or purchasing, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced below. If you do not accept these Terms, you must refrain from using the Site.

1. Definitions

• “Customer”, “you”, “your” – any person who accesses the Site or buys products from us.
• “Products” – raw dog-food meals, treats, supplements, and related items offered for sale.
• “Working days” – Monday to Friday, excluding South-African public holidays.

2. Eligibility & Account Security

You must be 18 years or older (or the age of majority in your province) to place an order. You are responsible for keeping any login credentials confidential and for all activities under your account.

3. Product Information & Dietary Responsibility

3.1 We strive to ensure all product descriptions, nutritional data, images, and feeding guidelines are accurate and current.
3.2 Always consult a qualified veterinarian before changing your dog’s diet, particularly if your pet has health issues, allergies, or is pregnant.
3.3 Our meals are formulated for dogs only and must not be fed to other animals or humans.

4. Pricing & Payment

4.1 All prices are shown in South-African Rand (ZAR) and include VAT unless stated otherwise.
4.2 We reserve the right to adjust prices at any time. The price displayed at checkout is the price payable.
4.3 Payment must be made via the secure gateways offered at checkout. Orders are processed only after full payment reflects in our account.

5. Ordering Process

5.1 Placing an order constitutes an offer to purchase Products under these Terms.
5.2 You will receive an order-confirmation e-mail; however, the contract is formed only once we dispatch the Products.
5.3 We may reject or cancel an order (with a full refund) for any lawful reason, including stock shortages, payment failure, or suspected fraud.

6. Delivery & Risk

6.1 Delivery is available within the Republic of South Africa to the areas indicated at checkout.
6.2 Estimated delivery times are guidelines only. We are not liable for delays beyond our reasonable control.
6.3 Risk in the Products passes to you on delivery. Inspect goods on arrival and report shortages or damage within 24 hours.

7. Returns & Refunds

7.1 Due to the perishable nature of raw pet-food Products, returns for change of mind are not accepted.
7.2 If Products arrive spoiled, damaged, or incorrect, notify us within 24 hours with photographic evidence. We will, at our discretion, replace or refund the affected items.
7.3 Nothing in this clause limits your rights under the Consumer Protection Act 68 of 2008 (“CPA”).

8. Ingredient Availability & Substitution (Disclaimer)

In the event that venison or another source ingredient is not available, an equivalent will be sourced. Replacement within pre-packed meals may occur without notice. We will endeavour to match nutritional profiles, but natural variations can occur.

9. Feeding Guidelines & Allergens

9.1 Feeding recommendations are guidelines only and may need adjustment for your dog’s size, age, and activity.

10. Intellectual Property

All content on the Site—text, graphics, logos, photos, recipes, and trademarks—is owned by or licensed to TFFD. You may not use, copy, reproduce, or distribute any content without our prior written consent.

11. Privacy & Data Protection

We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”). See our Privacy Policy for details on collection, use, and security of data.

12. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for indirect or consequential losses.
• Our aggregate liability for any claim arising out of these Terms or the Products will not exceed the amount you paid for the relevant order.
• Nothing excludes liability for death or personal injury caused by our gross negligence or for any liability that cannot be excluded under the CPA.

13. Indemnity

You indemnify us against all losses, liabilities, costs, or damages arising from your breach of these Terms or misuse of the Site or Products.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any dispute shall be submitted to the non-exclusive jurisdiction of the South-African courts. Consumers may refer disputes to the National Consumer Commission or an accredited consumer-protection body in terms of the CPA.

15. Changes to Terms

We may update these Terms at any time. The revised version will be posted on the Site with an updated “Last updated” date and is effective immediately. Continued use of the Site after changes signifies acceptance.

16. Force Majeure

We are not responsible for failure to perform or delays caused by events beyond our reasonable control, including natural disasters, supply interruptions, transport strikes, or pandemics.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.

18. Entire Agreement

These Terms, together with any policies expressly incorporated, constitute the entire agreement between you and TFFD regarding the Site and Products, superseding all prior agreements.
